1. Acceptance of Terms

These Terms & Conditions (“Terms”) are a legal agreement between you and GameOnTherapy LLC (“we,” “us,” or “our”), located at 10 Thunder Run, Apt 8C, Irvine, California 92614-7593, United States. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App. These Terms apply to the following applications: Evara, Nuvio, and Avola.

2. Eligibility

You must be at least the age of majority in your jurisdiction, or use the App under the supervision of a parent or legal guardian, to use the App. The App is not intended for children under the age of 13 (or under the minimum age of digital consent in your country).

3. Purpose of the App (Important)

The App is intended solely for self-tracking, informational, and personal reflection purposes. It does not provide medical advice, diagnosis, treatment, or clinical recommendations. The App is not a substitute for professional medical care.

4. No Medical Advice Disclaimer

The content provided through the App is for general informational purposes only. Nothing in the App should be construed as medical or mental health advice. Always seek the advice of a qualified healthcare provider regarding any medical or mental health condition.

5. User Responsibility

You acknowledge that you use the App at your own discretion and risk. You are solely responsible for:

• how you interpret the information provided
• any decisions you make based on your use of the App
• seeking professional help when necessary

6. Emergency Situations

The App does not provide emergency or crisis intervention services. If you believe you are experiencing a medical or mental health emergency, contact local emergency services immediately. Any crisis or emergency resources provided in the App are for informational purposes only.

7. Account & Access

Some features of the App may require account creation or authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

8. Subscription & Payments

Certain features of the App may require a paid subscription. All payments are processed through the applicable app store (Apple App Store or Google Play Store) and are subject to their respective terms and policies. We do not process payments or manage refunds directly.

Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription, and turn off auto-renewal, in your app store account settings. Where a free trial is offered, any unused portion of a trial is forfeited when you purchase a subscription. Prices may vary by region and are disclosed at the point of purchase.

9. Intellectual Property

All content, design, text, graphics, and software within the App are owned by or licensed to GameOnTherapy LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without prior written consent.

10. Prohibited Use

You agree not to use the App:

• for unlawful purposes
• to attempt to diagnose or treat medical conditions
• to interfere with the App’s operation or security
• to misuse, scrape, or exploit App data

11. Limitation of Liability

To the maximum extent permitted by law, GameOnTherapy LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Use of the App is at your own risk.

12. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or suitable for your specific needs.

13. Termination

We reserve the right to suspend or terminate access to the App at any time if these Terms are violated.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved in the state or federal courts located in California, and you consent to their jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise. Nothing in these Terms limits any statutory consumer rights that cannot be waived under applicable law.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. Updated Terms will be posted on this page.

16. Additional Terms for Apple App Store (End User License Agreement)

The following additional terms apply where you download the App from the Apple App Store. In the event of any conflict between these Apple-specific terms and the rest of these Terms, these Apple-specific terms govern with respect to your use of the App on Apple devices.

16.1 Acknowledgement

These Terms are concluded between you and GameOnTherapy LLC only, and not with Apple Inc. (“Apple”). GameOnTherapy LLC, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

16.2 Scope of License

The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

16.3 Maintenance and Support

GameOnTherapy LLC is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

16.4 Warranty

GameOnTherapy LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of GameOnTherapy LLC.

16.5 Product Claims

GameOnTherapy LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16.6 Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, GameOnTherapy LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

16.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.9 Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App.

16.10 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
